Brutus v Publius: Founders Fight To Define Judicial Review (Part One)
Today on Categorical Imperative is part one of a two part episode On the public battle during the ratification debates on Judicial Review. Looking at it from the perspective of two of the most well-written series of essays from that time. This is also the first episode of an idea I plan to make a regular feature of that I am tentatively calling *The Founders in Context*. This is also meant to shed a little light on a long neglected thesis by Brutus giving a downright prophetic warning, about how Judicial Review is liable to collapse into Judicial supremacy.
