Today on Legalese, we are returning to a Supreme Court case that I have been covering as part of my annual Supreme Court Roundup.
Devillier v Texas is a Takings Clause case in which petitioner (Devillier) is seeking compensation after his ranch was destroyed by the State of Texas when a highway construction project flooded his property.
On January 16th, oral arguments were made before the Court in this case. This round of arguments was incredibly useful in assessing where the Justices stand on this particular issue, how they will likely decide this case and why all signs point to a decisive (if not unanimous) opinion in favor of Devillier.
We also discuss why such a ruling would be a major victory for property rights in general. Plus, a look at the likely remedies the Court may employ and the importance of this potential landmark case on Takings Clause jurisprudence going forward. Especially inverse condemnation cases (a particular type of Takings claim that is at issue here.)
