Today on Legalese, we are discussing the The Biden Administration’s new Agency Rules put into effect by the Department of Labor that is meant to be the first step in destroying the Gig Economy. This possibility is one that we here at Legalese have been warning about for the better part of 5 years.

This move is ostensibly meant to "regulate" freelance workers and independent contractors, with the government insisting that contractors are being exploited. Therefore, our wise overlords have no choice but to intervene and save us from our own decisions. This is also necessary to allow workers the right to form a union if they wish to do so… Or at least that’s the government’s side of the story.

Really this is nothing more than a move to force millions of people who enjoy the flexibility and freedom of working as independent contractors to join labor unions as dues paying members.

So today we will be discussing these new Department Of Labor regulations.

Are independent contractors being exploited?
Would they prefer full-time employment over their current work arrangement?
Were these rules written to accomplish the objectives that the Department of Labor and the Biden Administration said they accomplish?
And what can we learn from the epic failure of the laws that these regulations were written to emulate— such as California’s AB-5 and the PRO Act?
